TERMS OF SERVICE

01 Agreement to Terms

These Terms constitute a legally binding agreement between you and Nexova Digital Solution (SSM No. 202603049266 / CA0417238-V), No. 6, Jalan U13/53A, Eco Ardence Seksyen U13, 40170 Shah Alam, Selangor. These Terms are governed by the Sale of Goods Act 1957, Consumer Protection Act 1999, and Electronic Commerce Act 2006.

02 Our Products and Services

// Digital Products

We sell digital products including software source code, automation bots, website templates, e-books, and digital toolkits. Products are delivered electronically via download link or access credentials upon confirmed payment.

// IT Consulting Services

Custom software development, system integration, server deployment, and IT consulting. These services are governed by a separate project agreement agreed upon before commencement.

03 Orders and Payment

All prices are in Malaysian Ringgit (MYR). We accept:

• FPX Online Banking (via Billplz)
• Touch 'n Go eWallet and GrabPay (via Billplz)
• Visa and Mastercard credit/debit cards (via Stripe)

Your order is confirmed once payment is successfully processed. We reserve the right to cancel any order in the event of payment failure, suspected fraud, or pricing errors.

04 Digital Product Delivery

Upon successful payment, products will be delivered via automated download link to your email, or directly via WhatsApp. Delivery is typically immediate or within 24 hours. If you do not receive your product within 24 hours, contact us immediately.

05 Licence for Digital Products

Upon purchase, we grant you a non-exclusive, non-transferable, personal licence to use the product for your own business or personal purposes.

You MAY use our products to build products and services for your clients as part of your own business operations.

06 IT Consulting Services

• A detailed scope of work will be agreed upon before project commencement
• A deposit of 50% is required before work begins
• Source code ownership transfers to the client upon full payment
• Timelines are estimates and may be adjusted based on complexity

07 Intellectual Property

All content on our website including text, graphics, logos, and software is the property of Nexova Digital Solution and is protected by Malaysian copyright law. Purchased digital products are licensed (not sold) to you as described in Section 5.

08 Limitation of Liability

• Our total liability shall not exceed the amount you paid for the specific product
• We are not liable for indirect, incidental, or consequential damages
• We do not guarantee products will meet every specific business requirement
• We are not responsible for third-party services or APIs our products interact with

09 Prohibited Uses

You agree not to use our products or services for any illegal activity under Malaysian law, spamming, phishing, fraud, or to create content that infringes third-party intellectual property rights.

10 Governing Law

These Terms are governed by the laws of Malaysia. Disputes shall first be attempted through good-faith negotiation, then subject to the jurisdiction of the courts of Malaysia.
